Article 1 – Definitions

The following terms are defined in these conditions:

  • Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.
  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a distance agreement with the entrepreneur.
  • Day: Calendar day.
  • Ongoing Performance Contract: A distance agreement regarding a series of products and/or services, with obligations spread over time.
  • Durable Data Carrier: Any tool that allows the consumer or entrepreneur to store information personally addressed to them in a way that enables future reference and unaltered reproduction.
  • Right of Withdrawal: The option for the consumer to cancel the distance agreement within the cooling-off period.
  • Model Form: The withdrawal form provided by the entrepreneur for consumers to use when exercising their right of withdrawal.
  • Entrepreneur: A natural or legal person offering products and/or services to consumers remotely.
  • Distance Agreement: An agreement where, within a system organized by the entrepreneur for remote sales, one or more means of distance communication are used exclusively until the conclusion of the agreement.
  • Means of Distance Communication: A method that can be used to conclude an agreement without the simultaneous presence of the consumer and entrepreneur.
  • General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer from the entrepreneur and any distance agreement or orders between the entrepreneur and the consumer.
  2. Before concluding a distance agreement, the text of these general terms and conditions will be provided to the consumer. If this is not reasonably possible, it will be indicated where the terms can be reviewed electronically, and they will be sent free of charge upon request.
  3. If the distance agreement is concluded electronically, these terms and conditions may also be provided electronically in a way that enables the consumer to store them on a durable data carrier.
  4. If, in addition to these general terms, specific product or service conditions apply, the consumer may invoke the provision most favorable to them in case of contradictions.
  5. If any provision of these general terms is deemed null or void, the remaining provisions remain effective.
  6. Situations not covered by these terms or ambiguities will be interpreted ‘in the spirit’ of these general terms and conditions.

Article 4 – The Offer

  1. Offers with limited validity or under specific conditions will be explicitly stated.
  2. The offer is non-binding, and the entrepreneur may adjust it.
  3. The offer includes a detailed description of the products and services for proper assessment. Any images must accurately represent the products. Errors in the offer do not bind the entrepreneur.
  4. The offer clearly states the consumer’s rights and obligations, including:
    • The price, including taxes;
    • Shipping costs;
    • The method of agreement conclusion and the required steps;
    • The applicable withdrawal right;
    • Payment, delivery, and execution terms;
    • The duration of the offer or price validity;
    • Information about data storage, accessible agreements, and alternative languages.

Article 5 – The Agreement

  1. Agreements are concluded once the consumer accepts the offer and fulfills the conditions.
  2. Upon electronic acceptance, the entrepreneur confirms receipt of acceptance. Without confirmation, the consumer may dissolve the agreement.
  3. For electronic transactions, the entrepreneur ensures secure data transmission.

Article 6 – Right of Withdrawal

For Products:

  • Consumers can cancel the agreement within 14 days of receiving the product without providing reasons.

For Services:

  • The consumer may cancel services within 14 days of agreement commencement.

Article 7 – Costs in Case of Withdrawal

  1. Consumers bear the return shipping costs when exercising withdrawal rights.
  2. Refunds are processed within 14 days of withdrawal, provided the product is returned.

Article 8 – Exclusion of the Right of Withdrawal

Withdrawal rights may be excluded for:

  1. Custom-made or personalized products.
  2. Products with a limited shelf life.
  3. Sealed goods or hygiene-sensitive products once unsealed.

Article 9 – The Price

  1. Prices during the validity period will not increase, except for VAT adjustments.
  2. Errors in prices do not obligate the entrepreneur to honor incorrect pricing.

Article 10 – Conformity and Warranty

  1. Products/services must comply with the agreement and statutory requirements.
  2. Warranties are additional to legal rights.

Article 11 – Delivery and Execution

  1. Orders are processed with care and delivered within agreed timelines (maximum 30 days).

Article 12 – Payment

  1. Payment must be completed within 7 days unless otherwise agreed.

Article 13 – Complaints Procedure

  1. Complaints must be reported within two months.
  2. Complaints are addressed within 14 days. If unresolved, consumers may escalate disputes to Stichting WebwinkelKeur or the European ODR platform.

Article 14 – Disputes

  1. These terms are governed by Dutch law, excluding the Vienna Sales Convention.

Article 15 – Product Disclaimer Clauses

Bow Toys is not liable for:

  • Direct/indirect damage caused by improper product use.
  • Risks associated with pet toys, which should be assessed by the buyer.

Supervision is required when products are used by pets or children. Bow Toys limits liability to the product cost and emphasizes safety warnings.
